Wirral TV Ltd Access Policy

1. Your Acceptance

A. By using and/or visiting this website (collectively, including all content and functionality available through the Wirraltv.net domain name, the ‘Wirral TV website’, or ‘website’), you signify your agreement to these terms and conditions and Wirral TV’s Community Guidelines. This shall take affect immediately. If you do not agree to any of these terms or Community Guidelines, please do not use the Wirral TV website. 

B. WTV may change these terms at any time by posting changes on the Wirral TV website. Please review these terms regularly to ensure you are aware of any changes made by WTV. Your continued use of the WTV website after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

C. The Wirral TV Website may contain links to third party websites that are not owned or controlled by Wirral TV. Wirral TV has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, Wirral TV will not and cannot censor or edit the content of any third-party site. By using the Website, you expressly relieve Wirral TV from any and all liability arising from your use of any third-party website. Accordingly, we encourage you to be aware when you leave the Wirral TV Website and to read the terms and conditions and privacy policy of each other website that you visit.

2. General Use of the Website- Permissions and Restrictions

Wirral TV Ltd hereby grants you permission to access and use the Website as set forth in these Terms of Service, provided that:

A. You agree not to distribute in any medium any part of the Website, including but not limited to user submissions, without Wirral TV’s prior written consent. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use WTV content in any way except for your own personal, non-commercial use. 

B. You agree not to alter or modify any part of the Website. 

C. You agree not to use the Website for any commercial use, without the prior written authorisation of Wirral TV. Prohibited commercial uses include any of the following actions taken without Wirral TV’s express approval:

sale of access to the Website or its related services on another website; 

use of the Website or its related services, for the primary purpose of gaining advertising or subscription revenue;

the sale of advertising, on the Wirral TV website or any third-party website, targeted to the content of specific User Submissions or Wirral TV content; 

any use of the Website or its related services that Wirral TV finds, in its sole discretion, to use Wirral TV 's resources or User Submissions with the effect of competing with or displacing the market for Wirral TV, Wirral TV content, or its User Submissions. 

D. In your use of the website, you will completely comply with the terms and conditions of these Terms of Service, Wirral TV Community Guidelines, and all applicable local, national and international laws and regulations.

E. Wirral TV reserves the right to discontinue any aspect of the Wirral TV Website at any time. WTV does not warrant that functions contained in WTV content will be uninterrupted or error free, that defects will be corrected, or that WTV or the server that makes it available are free of viruses or bugs. The Services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond our control. We will not be liable to you or to any other person in the event that all or any part of the Services is discontinued, modified or changed in any way. 

3. Your Use of Content on this Site

In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of content on the Wirral TV Website.

A. The content on the Wirral TV website, except all User Submissions, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like (‘Content’) and the trademarks, service marks and logos contained therein are owned and licensed by Wirral TV Ltd, subject to copyright and other intellectual property rights under law. Content on the website is provided to you "AS IS" for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of WTV or any other third party.

B. WTV content is provided on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

4. Contributions to WTV

A. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize WTV to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service. 

B. For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to WTV, you hereby grant WTV a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Wirral TV Website and Wirral TV's business, including without limitation for promoting and redistributing part or all of the Wirral TV Website (and derivative works thereof) in any media formats and through any media channels. If you do not want to grant to WTV the rights set out above, please do not submit your contribution to WTV.

C. Further to paragraph A and B, by submitting your contribution to WTV, you warrant that your contribution: 

is your own original work and that you have the right to make it available to WTV for all the purposes specified above; 

is not defamatory; and 

does not infringe any law. 

You indemnify WTV and any other third party against all legal fees, damages and other expenses that may be incurred by them as a result of your breach of the above warranty and  waive any moral rights in your contribution for the purposes of its submission to and publication on WTV and the purposes specified above. 

5. WTV Community Rules

You agree to use the WTV website in accordance with the following Community Rules. These apply across all WTV community sites and services. You should, however, read the local house rules of the particular site or service you’re using, as there may be some local variations to these Community Rules.

You may not submit any defamatory or illegal material of any nature to WTV. This includes text, graphics, video, programs or audio. You agree to use WTV website for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of WTV.  Harassing, defamatory, abusive, threatening, harmful, obscene, profane, racially offensive or otherwise objectionable material is not acceptable. 

Contributing material with the intention of committing or promoting an illegal act is strictly prohibited. 

You agree to only submit materials which are your own original work. You must not violate, plagiarise, or infringe the rights of third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights. 

Wirral TV will not accept pornographic or sexually explicit content.

No disruptive, offensive or abusive content. Contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble. 

Graphic or gratuitous violence is not allowed on the Wirral TV website. This includes animal abuse, videos showing someone getting hurt, attacked or humiliated.

Certain forms of language are unacceptable as they can cause offence. This includes: sexual swearwords, terms of racist abuse, terms of sexual and sexist abuse or abuse referring to sexuality, pejorative terms relating to illness or disabilities, casual or derogatory use of holy names or religious words and especially in combination with other offensive language.

There is zero tolerance for predatory behaviour, stalking, threats, harassment, invading privacy, or the revealing of other members’ personal details.

If you use multiple logins for the purpose of disrupting the community or annoying other users you may have action taken against your accounts. 

No spamming or off-topic material: we don’t allow the submission of the same or very similar contributions many times. Please don't re-submit your contribution more than once.

No advertising: either personal or on behalf of a third party. 

Contributions containing languages other than English will be scrutinised and may be removed if deemed to be in breach of any of these terms. 

No impersonation 

No inappropriate (e.g. vulgar, offensive etc) user names 

You may not refer to specific URLs (web site addresses) unless specifically agreed with WTV. 

6. Children and Consent:

Where a child or young person is included in any WTV activity, consent must be obtained from parents or legal guardians, or other persons of eighteen or over in loco parentis. The younger and more vulnerable the child, and the more sensitive the subject matter, the more likely it is that consent is essential. 

Content producers must ensure that the child featured in their content and the parent/guardian, or other person of eighteen or over in loco parentis, understand the nature of the programme and are able to give informed consent.

Content producers must respect a refusal of the child or young person to take part.

In deciding whether a child can give consent, the stage of development and degree of understanding as well as their age should be taken into account.

Content producers must ensure that any reasonably foreseeable consequences of the child’s participation are made clear, for example the possibility of bullying.

Content producers may not give any financial inducement to the child or parent/guardian to secure consent. The payment of expenses is acceptable as long as they are reasonable and legitimate.

Content producers must obtain permission from the head teacher for filming or interviewing on school premises or during school hours. In law, Local Education Authorities license all child performances during school hours.

7. Safety

We advise that you never reveal any personal information about yourself or anyone else (for example: telephone number, home address or email address), and please do not include postal addresses of any kind. 

You are entirely responsible for maintaining the confidentiality of your details when using our Services. 

If you have a helpful address to share, inform the host of the relevant Community Centre, and they will promote it if they see fit.

If you’re under 16 you should never reveal any personal information about yourself or anyone else (for example, telephone number, home address or email address).

8. Account Termination Policy

A. If you fail to abide by these Community Rules (and/or any variations in the relevant local house rules) when taking part in a WTV activity, you will be informed why your contribution has been failed or edited. This will also include a warning that continuing to break the rules may result in action being taken against you.

This action may include temporary or permanent suspension of your ability to participate in any or all of WTV activities, or access to WTV Website.

B. If you post or send offensive or inappropriate content anywhere on or to WTV or otherwise engage in any disruptive behaviour while using WTV equipment and /or facilities, and WTV considers such behaviour to be serious and/or repeated, WTV may use whatever information that is available to it about you to stop any further such infringements. This may include informing relevant third parties such as your employer, school or email provider about the infringement/s.

C. WTV reserves the right to delete any contribution, or take action against any user, at any time, for any reason.

9. Warranty Disclaimer

YOU AGREE THAT YOUR USE OF THE WTV WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WTV, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. WTV MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE WTVWEBSITE. WTV DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE WTV WEBSITE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WTV WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

10. Limitation of Liability

IN NO EVENT SHALL WTV, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE WTV WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. 

YOU SPECIFICALLY ACKNOWLEDGE THAT WTV SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. 

11. General

A. These terms shall be governed by and interpreted in accordance with the laws of England and Wales.

B. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

C. The views expressed in WTV content are those of members of the public and are not necessarily those of the WTV.

D. Nothing in these Terms of Use will: restrict your statutory rights as a consumer (including your rights to receive a reasonable standard of service, more details about which can be obtained from your local Trading Standards Office or Citizen's Advice Bureau).

E. Nothing in these Terms of use will limit our liability for death or personal injury resulting from our negligence or for fraud. 

F. These Terms of Use shall not make us responsible for any damage or loss caused to you where such damage or loss is not reasonably foreseeable to you and us when you use the Services, including where the damage or loss results from our breach of these Terms of Use.
